This Disclaimer explains important limitations concerning content strategy, copy, visual content, social media materials, advertising creative, campaign management, performance information, and general website statements provided by Mindful Readers. It should be read with the Terms of Service and the applicable project agreement.
2. Creative and marketing services
Mindful Readers provides creative and operational services designed to help businesses organize messages and prepare materials for selected channels. These services involve professional judgment and are not a substitute for the client's own business decision-making, product review, compliance program, sales process, customer support, or management responsibility.
3. No guaranteed results
No content plan, social post, advertisement, creative concept, campaign structure, optimization decision, or management activity can guarantee a particular commercial result. Mindful Readers does not guarantee platform approval, rankings, impressions, reach, followers, engagement, leads, conversions, sales, revenue, profit, return on advertising spend, customer acquisition cost, brand recognition, or market share.
Actual outcomes may be affected by the offer, product quality, pricing, market demand, competition, audience, media budget, landing page, website performance, account history, tracking accuracy, sales response, seasonality, economic conditions, platform algorithms, privacy restrictions, and other factors outside direct control.
4. Estimates and projections
Any budget suggestion, forecast, benchmark, target, expected range, scenario, or planning assumption is an estimate based on available information and is not a promise. Historical campaign information does not ensure future performance. A platform's projected reach, optimization score, modeled conversion, or attribution report is generated under that platform's methodology and may change.
5. Client responsibility for claims
The client is responsible for the truth, accuracy, completeness, and substantiation of statements about its products, services, prices, offers, comparisons, testimonials, results, warranties, availability, qualifications, and business practices. The client must review and approve factual claims before publication and maintain supporting evidence when required.
Mindful Readers may ask questions, recommend clarification, or decline a statement that appears unsupported, but does not independently certify every client claim. Approval by Mindful Readers is not legal clearance or regulatory approval.
6. Truthful advertising and disclosures
Advertising should be truthful, not misleading, and supported by an appropriate basis for material claims. In the United States, advertising and endorsement practices may be subject to Federal Trade Commission standards as well as other federal, state, industry, and platform requirements. Material qualifications should be clear and conspicuous in the context in which an advertisement appears. When an endorsement, testimonial, influencer relationship, affiliate arrangement, incentive, or other material connection requires disclosure, the client is responsible for providing accurate relationship information and approving a compliant disclosure.
Platform disclosure tools may not, by themselves, satisfy every applicable obligation. Industry-specific claims may require specialized review by qualified counsel or another professional.
7. Platform approval and policy changes
Advertising networks and social platforms independently decide whether to approve, limit, reject, remove, or suspend content, campaigns, accounts, or payment methods. They may change specifications, policies, moderation practices, targeting options, attribution models, algorithms, or account requirements without notice to Mindful Readers.
Mindful Readers may prepare creative with known platform practices in mind and may assist with reasonable adjustments within the scope, but cannot override a platform decision or guarantee restoration of an account or advertisement.
8. Advertising budgets and billing
Digital Advertising Management fees do not include advertising spend. Media budgets and platform charges are the client's responsibility and may continue until campaigns are paused or stopped within the relevant account. Reporting and billing may be delayed or adjusted by a platform. The client should monitor payment methods, account limits, and platform invoices.
9. Performance data and attribution
Campaign reports rely on data made available by platforms, analytics services, websites, and the client. Such data may be incomplete because of cookie restrictions, consent choices, device changes, browser limitations, deleted identifiers, offline activity, attribution windows, duplicated events, technical errors, modeled data, or cross-platform differences.
Metrics should be interpreted as operational indicators rather than audited financial results. A reported conversion may not equal a completed sale, collected payment, qualified customer, or net profit.
10. Tracking implementation
Unless expressly included, Mindful Readers does not guarantee the design, legal compliance, or technical accuracy of a client's website tracking, consent system, tag manager, commerce data layer, customer list, or analytics implementation. The client should ensure that tracking technologies and audience data are used with required notices, permissions, security, and opt-out mechanisms.
11. Client-provided materials
Mindful Readers may rely on logos, images, music, copy, customer data, testimonials, claims, trademarks, and other materials supplied by the client. The client represents that it has the rights, permissions, releases, and lawful basis needed to use and share those materials. Mindful Readers is not responsible for hidden ownership disputes or restrictions not disclosed by the client.
12. Third-party assets
Stock content, fonts, templates, software, plugins, media, and other licensed resources remain subject to their original terms. A license may restrict modification, redistribution, trademark use, resale, or transfer. Payment for a project does not expand a third-party license. The client should preserve license records supplied with deliverables.
13. Creative judgment and subjective response
Creative work is inherently interpretive. Audience response may differ from client preference or internal stakeholder expectations. Mindful Readers will follow the approved brief and complete included revisions but does not warrant that every viewer will understand, like, remember, or act on a creative concept.
14. Testimonials and examples
If a testimonial, case description, sample, or performance example appears on the website or in a proposal, it reflects the identified person's experience or the stated context. It is not a guarantee that another client will receive the same result. Client reviews may be shortened or lightly formatted for spacing, punctuation, or presentation, but should not be intentionally edited to change their substantive meaning. Material relationships, incentives, or other connections should be disclosed when applicable.
15. No legal or regulated-profession advice
Mindful Readers does not provide legal, tax, accounting, investment, financial, medical, employment, privacy-compliance, or regulatory advice. Content relating to regulated products, professional claims, promotions, contests, testimonials, data use, or industry-specific disclosures should be reviewed by a qualified professional selected by the client.
16. Third-party links and providers
References to platforms, websites, tools, or service providers do not create responsibility for their content, privacy practices, security, uptime, pricing, policies, or decisions. The client should evaluate third-party providers independently and maintain appropriate account controls.
17. Reliance and limitation
Business decisions should not be based solely on general website content or a single campaign metric. To the maximum extent permitted by law, Mindful Readers is not responsible for losses caused by reliance on unverified information, client-approved claims, platform decisions, market conditions, inaccurate third-party data, or actions taken outside the agreed scope.
18. Questions
Questions about the intended use, assumptions, deliverables, or limitations of a specific service should be raised before approval or publication so that the applicable scope can address them in writing.
